Hereinafter, collectively: THE PASSENGERS.
MOREOVER, Madrid Roll, as a travel agency with license no. C.I.MU.529.m, with its registered office for all legal purposes at: Calle San Leandro 2, 30383 Los Nietos, Murcia, tax identification number: Z3360877F, e-mail: info@rolliodemadrid.com, website: www.rolliodemadrid.com, hereinafter THE AGENCY.
Both parties acknowledge each other's general legal capacity to enter into this agreement, and
DECLARE
I.- That the AGENCY is a legally registered Travel Agency, holding all necessary permits and authorizations to conduct its business.
II.- THE TRAVELER expresses interest in using the services offered by the Travel Agency, such as booking transportation tickets, excursions, or car rentals, as well as other services provided by the Travel Agency. It is expressly stated that the services do not include accommodation and have a duration of less than twenty-four hours, in accordance with the provisions of Article 150.2.a) of Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws. Consequently, the subscription of this contract does not constitute a travel package contract, which refers to the pre-arranged combination of transport, accommodation, or other tourist services offered as a whole under a single contract, and it is clearly outside the scope of the specific legislation on travel packages and linked travel services.
The parties, having reached an agreement on the subject matter, hereby enter into this Service Agreement (hereinafter referred to as the "AGREEMENT") on the following terms:
ENCLOSURES
FIRST.- SUBJECT
Based on the detailed submission, the parties agree to provide mutual services which are the subject of the AGREEMENT, as follows:
Organizational and intermediary services provided by the AGENCY to the PASSENGER, including cultural, gastronomic, entertainment visits, or guided tours for small groups, including, if applicable, private airport transfers, if ordered by the PASSENGER.
The specific content of the services, detailed descriptions, individual conditions, dates, prices, and, where applicable, cancellation policies are included in the pre-contractual information provided by THE AGENCY to THE PASSENGER prior to the conclusion of the contract.
The quality and content of services provided by providers are determined by the official tourist category assigned by the competent authorities and/or authorized body of the country, if available.
SECOND. - OBLIGATIONS OF THE PARTIES
Without prejudice to the other obligations specified in the AGREEMENT and/or by law, the parties undertake the following:
The agency's obligations:
To perform the services specified in the preceding clause with due diligence as a trustee, taking all necessary measures with respect to the various service providers contracted, and to promptly inform THE PASSENGER of any changes, modifications, or events of which THE AGENCY becomes aware.
Customer Obligations:
Payment of appropriate prices, fees, duties, and costs, and compliance with other obligations specified in this agreement.
THIRD. - AUTHORITY
The term of the PRESENT AGREEMENT coincides with the duration of the performance of the services defined in the FIRST CLAUSE.
FOURTH. PRICE AND PAYMENT METHOD
Price of contracted services: _____________ €.
The PASSENGER pays the AGENCY in full for all services at the time of booking. Accepted payment methods are bank transfer or credit card payment through the online booking system. In case of bank transfer, payment should be made to the agency's account as follows:

The passenger is obliged to make payment before the commencement of the contracted services (whether provided by the AGENCY or its partners).

FIFTH.- CANCELLATION FEES
The present AGREEMENT involves cancellation fees. THE PASSENGER may cancel the service at any time prior to the commencement of service, subject to the following cancellation fees:
Cancellation Policy:
• In case of cancellation at least 7 days before the date of service: the amount paid 100%- return.
In case of cancellation within 7 days, but at least 24 hours before the start of the service: the amount paid 50%- return.
In case of cancellation less than 24 hours before the start, or failure to appear at the specified place and time: no refund will be issued.
The application of these terms does not preclude the AGENCY from evaluating alternative solutions at its sole discretion in exceptional cases.
SIXTH.- PERSONAL DATA PROTECTION
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation, GDPR) and Law No. 3/2018 of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights, the TRAVELER is informed that their personal data will be processed by the AGENCY as data controller, for the purpose of managing, executing, and maintaining the relationship arising from the present TOURIST SERVICES CONTRACT. This includes everything necessary for the proper organization and provision of the ordered services.
The data will be stored within the scope of this AGREEMENT and until the statute of limitations for liabilities arising from the contractual relationship. We inform the TRAVELER that for the proper processing and provision of the ordered tourism services, personal data will be transferred to tourism companies directly involved in the organization of the trip. This includes, but is not limited to, airlines, transportation companies, hotels and other accommodation providers, booking centers, car rental companies, travel insurance companies, and organizers and providers of activities or excursions.
Similarly, data may be shared with Public Authorities when necessary to fulfill legal obligations.
In cases where a service provider to whom we transfer data is located outside the European Economic Area, this constitutes an international transfer of personal data. In such cases, the AGENCY guarantees that such transfers will be carried out securely and in compliance with applicable regulations, with appropriate safeguards such as the signing of Standard Contractual Clauses (SCCs) approved by the European Commission or other legally mandated protective mechanisms.
In any case, THE DATA SUBJECT may exercise their rights of access, rectification, erasure, opposition, restriction, and data portability towards the AGENCY by written notification to the registered office indicated at the beginning of this document. Likewise, if they consider that their right to the protection of their personal data has been violated, they may file a complaint with the Spanish Data Protection Agency (www.aepd.es).
Sending third-party data (e.g., travel companions) means that the customer has informed them and obtained their consent for their data to be processed according to the conditions described herein.
SEVENTH.- APPLICABLE LAW
In the event of any dispute arising from the interpretation or execution of the PRESENT AGREEMENT, the parties expressly waive any other available jurisdiction and submit themselves to the jurisdiction of the Courts and Tribunals of the city of the PASSENGER's domicile.
AS PROOF OF THEIR AGREEMENT, the parties sign the present AGREEMENT in two copies, with the same legal effect, at the place and date indicated in the header.

I.- That THE AGENCY is a legally constituted Travel Agency that possesses all the necessary permits and authorizations for the exercise of its activity.
II.- THE TRAVELLER expresses their interest in contracting the services offered by the Travel Agency, such as booking management for tickets on any means of transport, excursions, or vehicle rentals, or other services operated by the Travel Agency. It is expressly clarified that the services do not combine with accommodation, and that they have a duration of less than twenty-four hours, in accordance with the provisions of Article 150.2.a) of Royal Legislative Decree 1/2007, approving the Revised Text of the General Law for the Defense of Consumers and Users; consequently, this contracting does not constitute a package travel contract, understood as the joint combination of transport, accommodation, or other travel services under a single contract, and falls clearly outside the scope of application of the specific regulations on package travel and linked travel services.
And to this end, the parties agree, having reached an agreement on this matter, to execute this Service Provision Agreement, hereinafter the CONTRACT, in accordance with the following:
CLAUSES
FIRST. - PURPOSE
Taking into account the provisions of the recitals, the intervening parties express the reciprocity of the services to be provided, establishing the purpose of the CONTRACT in the following terms:
THE AGENCY's provision of organization and intermediation services for contracting by THE TRAVELLER, consisting of cultural, gastronomic, leisure visits, or guided tours for small groups, including, where applicable, a private airport transfer service if contracted by THE TRAVELLER.
Likewise, the specific content of the contracted services, including their detailed description, specific conditions, schedules, prices and, where applicable, cancellation policy, will be that which appears in the pre-contractual information provided by THE AGENCY to THE TRAVELLER prior to contracting.
The quality and content of the services provided by the suppliers will be determined by the official tourist category, if any, assigned by the competent bodies of the country and/or delegated authority.
SECOND.- OBLIGATIONS OF THE PARTIES
Without prejudice to other commitments indicated in this CONTRACT and/or by law, the parties bind themselves to:
Obligations assumed by THE AGENCY:
To carry out the due diligence of an agent for the provisions indicated in the previous clause, performing all necessary procedures and steps required with the various providers of the contracted services and to communicate to THE TRAVELLER, immediately upon THE AGENCY becoming aware, any modification, variation, or incident that may occur.
Obligations assumed by THE CLIENT:
To make the payment of the corresponding prices, fees, taxes, and disbursements incurred, as well as to comply with the remaining obligations established in this agreement.
TERM
This CONTRACT shall have a duration that coincides with the provision of the service indicated in the FIRST CLAUSE.
FOURTH. PRICE AND PAYMENT METHOD
The price of the contracted services is _____________ €.
THE TRAVELLER shall pay THE AGENCY for all services through payment to be made in full at the time of booking. Bank transfer or card payment through the online booking system are accepted as payment methods. In the case of a bank transfer, payment shall be made to the agency's holding account:

The payment must be settled by the traveler before the start of the contracted services, whether these are provided by the agency or its third-party collaborators.

FIFTH.- CANCELLATION FEES
This CONTRACT includes cancellation fees. THE TRAVELLER may cancel the contracted service at any time before its commencement, subject to the following cancellation fees:
Terms of cancellation:
• Cancellations made up to 7 days before the date of the service: 100% refund of the amount paid.
• Cancellations made between 7 days and 24 hours before the start of the service: 50% refund of the amount paid.
• Cancellations made less than 24 hours in advance, as well as the non-appearance of the client at the indicated place and time, shall not entitle to a refund.
These conditions shall apply without prejudice to the fact that, in exceptional cases, THE AGENCY may assess alternative solutions at its discretion.
SIXTH.- PERSONAL DATA PROTECTION
In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (General Data Protection Regulation) and Organic Law 3/2018 of December 5 on the Protection of Personal Data and guarantee of digital rights, THE TRAVELLER is informed that their personal data will be processed by THE AGENCY, as the data controller, in order to manage, execute, and maintain the relationship arising from this CONTRACT for the provision of tourist services. This includes everything necessary to correctly organize and provide the contracted services.
The data will be retained for the duration of this AGREEMENT and until the corresponding liabilities arising from the contractual relationship have expired. Likewise, the TRAVELER is informed that in order to correctly manage and provide the contracted tourist services, personal data will be communicated to companies in the tourism sector directly involved in the organization of the trip. This includes, but is not limited to, airlines, transport companies, hotels and other accommodations, booking centers, car rental companies, travel insurance companies, tour operators, and providers of activities or excursions.
Likewise, when necessary to comply with legal obligations, the data may be communicated to Public Administrations.
In cases where any of the providers to whom the data is communicated is located outside the European Economic Area, this communication will involve an international transfer of personal data. In these scenarios, THE AGENCY guarantees that said transfer is carried out securely and in accordance with current regulations, having adequate safeguards for this purpose, such as the signing of Standard Contractual Clauses (SCC) approved by the European Commission or other legally provided protection mechanisms.
In any case, THE TRAVELLER may exercise their rights of access, rectification, erasure, objection, restriction, and portability before THE AGENCY through written communication to the registered office listed at the beginning of this document. Likewise, if they consider their right to personal data protection to have been violated, they may file a complaint with the Spanish Data Protection Agency (www.aepd.es).
Sending third-party data (e.g., for companions) implies that the client has informed them and obtained their consent for the processing of their data under the terms described herein.
SEVENTH.- APPLICABLE JURISDICTION
For any dispute arising from the interpretation or execution of this CONTRACT, the parties agree to submit to the Courts and Tribunals of the city of THE TRAVELLER's domicile, expressly waiving any other jurisdiction that might apply.
AND IN WITNESS WHEREOF, both parties sign this CONTRACT in duplicate copies and to a single effect at the place and date indicated in the heading.

EXPONENTS
I.- THAT AGENCY is a legally constituted Travel Agency that has all the necessary permits and authorizations for the exercise of its activity.
II.- The TRAVELER expresses their interest in contracting the services offered by the Travel Agency, such as managing reservations for tickets on any means of transport, excursions, vehicle rentals, or other services operated by the Travel Agency. It is expressly clarified that the services are not combined with accommodation and that they have a duration of less than twenty-four hours, in accordance with Article 150.2.a) of Royal Legislative Decree 1/2007, which approves the Consolidated Text of the General Law for the Defense of Consumers and Users. Consequently, this contract does not constitute a package travel contract, understood as the joint combination of transport, accommodation, or other travel services under a single contract, and is clearly outside the scope of application of the specific regulations for package travel and linked travel services.
And to this end, the parties agree, having reached an agreement on the matter, on the execution of the present Service Agreement, hereinafter the AGREEMENT, in accordance with the following:
CLAUSES
ARTICLE ONE. - OBJECT
In light of the foregoing, the parties involved acknowledge the reciprocity of the services to be rendered, establishing the object of the AGREEMENT as follows:
The Agency's provision of organization and brokerage services for the Traveler's bookings, consisting of cultural, gastronomic, leisure, or guided tours for small groups, including, where applicable, a private airport transfer service, when contracted by the Traveler.
Likewise, the specific content of the contracted services, including their detailed description, specific conditions, schedules, prices, and, where applicable, cancellation policy, will be that which appears in the pre-contractual information provided by THE AGENCY to the TRAVELER prior to the contract.
The quality and content of the services provided by the suppliers shall be determined by the official tourist category, if any, assigned by the competent authorities of the country and/or delegated authority.
SECTION 2. – OBLIGATIONS OF THE PARTIES
Without prejudice to the other commitments set forth in this AGREEMENT and/or by law, the parties undertake to:

Proceed with the payment of the corresponding prices, fees, charges, and incidental expenses, as well as respect the remaining obligations established in this agreement.

FOURTH.- PRICE AND PAYMENT METHOD

Cancellations made less than 24 hours in advance, as well as no-shows, will not be eligible for a refund.
These conditions shall apply without prejudice to the fact that, in exceptional cases, THE AGENCY may consider alternative solutions at its discretion.

This includes everything necessary to properly organize and provide the contracted services.
The data will be kept for the duration of this AGREEMENT and until the corresponding liabilities arising from the contractual relationship expire. Likewise, THE TRAVELER is informed that in order to correctly manage and provide the contracted tourist services, personal data will be communicated to companies in the tourism sector directly involved in the organization of the trip. This includes, but is not limited to, airlines, transportation companies, hotels and other accommodations, booking services, car rental companies, travel insurance companies, and operators and providers of activities or excursions.
Likewise, when necessary to comply with legal obligations, data may be communicated to Public Administrations.

For any discrepancy resulting from the interpretation or execution of this AGREEMENT, the parties agree to submit to the Courts of the city of the TRAVELER's domicile, expressly waiving any other jurisdiction that may apply.
AND IN WITNESS WHEREOF, both parties sign this AGREEMENT in duplicate and for a single purpose at the place and date indicated in the preamble.
